POLICY FOR THE USE OF BELLASERA COMMUNITY ASSOCIATION RECREATIONAL FACILITIES

Definitions

1. Common Area: "All real and personal property which the Association now or hereafter owns …for the common use and enjoyment of the Owners…" and "…include[s] …scenic corridors and may include entry features, landscape medians, and cul-de-sacs."

2. Recreational Facilities: Those parts of the Common Area which are suitable for recreational use. These are the clubhouse (including patios and parking lot), the pool area (including jacuzzi and deck), the grass area outside the clubhouse, the basketball court, the tennis courts, and the activity room (the large room on the south side of the clubhouse, including both halves of the room and the kitchen). The remainder of the Common Area is not considered recreational facilities.

3. Owner: The owner of record of a lot. It is used herein to include also family members, co-occupants, and lessees in regard to the use of facilities.

General Policy

1. The Bellasera recreational facilities are for the common use and enjoyment of the owners. This policy is intended to establish rules and regulations for the use of those recreational facilities and applies to all owners

2. The facilities are available to all owners equally, except as follows:

a. An owner whose account is delinquent is not permitted to use any of the Association's recreational facilities until his or her account is brought current.

b. An owner whose right to use recreational facilities has been suspended by the Board for a violation is not permitted to use any of the Association's recreational facilities, except the grass area, while so suspended.

c. For a lessee to have use of or access to a facility the owner must have notified the Community Manager about the legal leasing of his or her lot, thereby abandoning his or her own right to the use of any recreational facility. The owner must also return his or her clubhouse access key tabs to the Community Manager. The Community Manager will issue tabs to the lessees.

3. "Social invitees" are permitted. Other "invitees", such as religious groups, political groups, charities, and other such organizations may be granted use and access only upon recommendation of the Community Manager and express approval by the Board.

4. An owner extending his or her right of use to a social invitee must be physically present at all times while the invitees are using the facility, including preparation and cleanup. For use by family, co-occupants, or lessees the owner's presence is not required.

5. An owner is responsible for the behavior of the group in attendance and is expected to control the behavior of the invitees at all times An owner sponsoring an activity is responsible to ensure that no illegal activity (e.g., under-age drinking, vandalism, etc) is committed by facility users on Bellasera property,. The owner has the prime responsibility to call law enforcement officials should it be necessary. The gate guard should also be notified.

6. Use of recreational facilities other than as set forth in this policy may be authorized by the Board on a case-by-case basis.

7. Facilities are available for use during authorized times only.

Enforcement

1. Any owner who fails to abide by the terms of this policy will be considered to be in violation of this policy and may by action of the Board be barred from using the recreational facilities for a period not to exceed 30 days. Continuing violations may result in revocation of use for longer periods. Any such Board action will be implemented after notice pursuant to Section 3.25 of the By-Laws.

2. Owners violating this policy may be assessed fines up to $250 as approved by the Board. These fines may be in addition to charges assessed for cleaning charges or for damage to facilities as a result of use by an owner or social invitees. These fines will be assessed after notice pursuant to Section 3.25 of the By-Laws

3. Fines and damages shall be assessed to the owner's Association account.

Specific Policies

Clubhouse Policy

1. The clubhouse is open daily to the Residents and their guests from 5 A.M. until 12 P.M..

2. No pets are permitted in the building at any time.

3. No smoking is permitted within the building at any time.

4. Complaints, concerns and compliments should be addressed to the Community Manager at 480-488-0400 or in person during business hours at the management office located in the clubhouse.

5. ALL EMERGENCIES:
CALL 911 AND THEN NOTIFY SECURITY AT THE MAIN GATE.
OFFICERS ARE CPR CERTIFIED.

Activity Room Policy

1. Use of the activity room for authorized activities of the Association, whether one time or on a regular basis, must be scheduled and approved by the Community Manager. Such activities may include but are not limited to Board and committee meetings and clubs (poker, bridge, etc.).

2. Use of the activity room for activities of benefit to the community (public presentations, public meetings, etc.) is permitted. They must be approved and scheduled by the Community Manager and approved by the Board.

3. Use of the activity room for group participation activities of benefit to the community (yoga, Pilates, exercise classes, etc.) is permitted. They must be approved and scheduled by the Community Manager.

4. When the activity room is used for any approved activity in 1 or 3 above, the Community Manager shall be responsible to ensure that the majority of the participants are owners and that the activity is being conducted primarily for the benefit of Bellasera owners. Non-owners may participate, but only to the extent needed to ensure the availability of the activity to owners.

5. If any of the users are under 18 years of age, an owner 18 years or over must be present at all times.

6. Use of the activity room by an owner for private events must be requested in advance from the Community Manager. Reservations may be made up to six months in advance. The intended use must be stated. The Community Manager will approve or disapprove the request based on this policy. The owner may appeal the decision to the Board immediately by contacting the President (or the Vice President in the President's absence).

7. The activity room must be used for the purpose stated.

8. The number of attendees must not exceed the maximum capacity of the facility. For social events, this is 70 persons. For Association authorized activities this number may be exceeded under the supervision of the Community Manager.

9. Use of the activity room does not give the owner or invitees any priority in any other part of the clubhouse or pool area.

10. Keys will be given by the gate guard to the owner only, not any invitee. The owner must sign and legibly print his or her name, local phone number and address on the sign out sheet. The contract will include agreement regarding time keys are to be returned.

11. There will be no charge for use of the room for Association authorized activities as set forth in paragraphs 1, 2, and 3 above.. A fee of $50.00 will be charged for the use of the room for private events

12. An owner may choose to have the Association provide for cleaning of the room after a private event. There will be a $100 charge for this service. If the owner prefers to arrange for the cleaning himself or herself, a refundable cleaning deposit of $100 will be required. No cleaning deposit or charge will be required for activities set forth in paragraphs 1, 2, and 3 above. If extra chairs or special provisions will be needed, the participants should contact the Association office to make arrangements. The room must be restored to its prior condition after use.

13. If the room is to be cleaned by the owner after a private event it must be completed by 7 AM of the day following the event. The entire deposit will be returned if the room is returned to the same condition as before the event. All exercise equipment, chairs and tables that are used or moved must be returned to where they were originally. The carpet must be vacuumed and cleaned. All trash must be double bagged, removed and placed in the dumpster located by the tennis courts. The kitchen and appliances must be cleaned and the refrigerator emptied. All decorations must be removed. If any areas of the clubhouse other than the activity room are used by the owner and his or her invitees, those areas must be cleaned up as well.

14. If in the opinion of the Community Manager the room is not adequately cleaned, the entire $100 cleaning deposit will be forfeited and the Community Manager will arrange for adequate cleaning as soon as possible.

15. Costs incurred as a result of damage will be assessed to the owner's Association account as set forth in paragraph 3 of Enforcement above.

Grass Area Policy

1. This area is open to all owners and their social invitees equally during authorized hours. No reservations are permitted.

2. The only exception to this provision is when the Association, with specific Board approval, sponsors a special event requiring use of the grass area.

3. Owners with dogs in this area, as owners elsewhere throughout the community, are required under City of Scottsdale ordinances to restrain their dogs on a leash 6' or less in length and to pick up after their dogs.

Exercise Area Policy

1. This area is open to all owners and their social invitees equally during authorized hours. No reservations are permitted.

2. Invitees accompanied by an owner are permitted so long as they do not prevent use of the equipment by other owners and so long as they limit the use of a particular piece of equipment to established time limits.

3. Because of safety issues, children under the age of sixteen (16) are permitted to use the exercise and workout equipment in the facility only under the close supervision of a parent or legal guardian.
4. Appropriate attire is required at all times.

5. Shoes are required at all times when working on or near the fitness equipment.

6. Complaints, concerns and compliments should be addressed to the Community Manager at 480-488-0400 or in person during business hours at the management office located in the clubhouse.

CALL 911 AND THEN NOTIFY SECURITY AT THE MAIN GATE.
OFFICERS ARE CPR CERTIFIED.

Pool Area Policy

1. This area is open to all owners and their social invitees equally during authorized hours. No reservations are generally permitted. However, use of the pool for group participation activities of benefit to the community (e.g., aqua gym) is permitted. These activities must be approved and scheduled by the Community Manager

2. In addition the Association, with specific Board approval, may sponsor a special event requiring use of the pool area .

3. The number of invitees of any owner at one time may be limited by the Community Manager.

4. The swimming pool and spa are open daily from 5:00 A.M. until 12 P.M. Pool hours will be strictly enforced.

5. The Community Manager may deny access to the pool at any time due to occupancy limits, weather, pool conditions or if maintenance is required.

6. There will not be a lifeguard on duty at the Bellasera Clubhouse pool. The use of the pool facilities is at the owner's or guest's own risk and by use of the facility the user agrees to hold the Bellasera Community Association harmless in regard to liabilities of any kind related to the use of the facility.

7. Parents are responsible for their children at all times. An owner who is eighteen (18) years of age or older must accompany all children under the age of fourteen (14) at all times in the pool area.

8. Children under the age of ten (10) using the spa must be closely supervised by an owner who is eighteen (18) years of age or older.

9. Owners are responsible for any damage they or their invitees cause while using the facilities.

10. Owners are responsible for cleaning up any mess or trash created by them, for closing the umbrellas used and straightening the patio furniture they used.

11. Owners and their invitees must refrain from any activity that is either a nuisance to other owners or invitees or in any manner damages Bellasera Community Association property.

12. No running, roughhousing, general horseplay, or disorderly conduct that will endanger the safety of others is allowed.

13. No diving, somersaults, back dives, cannonballs, preacher seats, can openers, or similar type entries from the edge of the pool are permitted.

14. No flotation devices are allowed in the pool with the exceptions of exercise equipment and children's safety devices.

15. No personal audio devices without earphones are permitted in and around the pool area with the exception of Association authorized activities..

16. No glass containers are allowed.

17. No roller skates/blades, skateboards or bicycles are permitted in the pool area. Children's strollers are allowed.

18. Aqua aerobics and swim classes have priority in the pool. Please consult the office for class schedules.

19. Appropriate swimwear is required. No long pants, denim or cut-offs are allowed.

20. Individuals who are not toilet-trained must wear appropriate swim diaper applications.

21. No pets are permitted in the pool area at any time.

22. No smoking is permitted in the pool area at any time.

23. Complaints, concerns and compliments should be addressed to the Community Manager at 480-488-0400 or in person during business hours at the management office located in the clubhouse.

24. ALL EMERGENCIES:

Basketball and Tennis Courts Policy

1. The basketball court and tennis courts are available to all owners and their invitees at all times during authorized hours on a first come basis, first served basis. Maximum of two (2) hours court time allowed.

2. Reservations are not generally permitted, but reservations for special events may be approved by the Community Manager.

3. The number of invitees of any owner at one time may be limited by the Community Manager.
4. Tennis and basketball courts will be available from 5 A.M. until 10 P.M. daily.

5. No food or beverage items other than water in plastic containers are allowed on the tennis courts.

6. Bicycles, roller blades, skateboards and any similar equipment are strictly prohibited from the courts or the areas around the courts.

7. Appropriate tennis attire must be worn at all times when using the courts. Appropriate attire includes a shirt and non-marking soled shoes.

8. Appropriate attire must be worn at all times while playing basketball. Appropriate attire includes a shirt and non-marking soled shoes.

9. Running shoes are not permitted on the courts.

10. No pets are permitted in the court area at any time.

Lounge/TV Area Policy

1. The lounge area is available to all owners and their invitees at all times during authorized hours.

Massage Room Policy

1. The massage room may be used for personal services suitable to the room and for the benefit of Bellasera owners. Owners may reserve the massage room to receive personal services from a practitioner of their choice.

2. Use of the massage room must be approved and scheduled by the Community Manager.

Rules and Regulations

The Bellasera Community Center is for your use and enjoyment. We need the cooperation of all residents to make the community center a fun, safe and sanitary facility for everyone. Owners must advise all residents and their guests of the rules and safety precautions. The following rules must be observed at all times.

1. The common area owned by the Bellasera Community Association is available to Residents and their guests subject to all of the restrictions in the Bellasera governing documents as well as these and other Rules and Regulations adopted by the Association.
2. The community center is open daily to the Residents and their guests from 5 am until midnight.
3. Because of safety issues, children under the age of sixteen are permitted to use the exercise and workout equipment in the facility under the close supervision of a parent or legal guardian only.
4. Appropriate attire is required at all times.
5. Shoes are required at all times when working on or near the fitness equipment.
6. All injuries and other related accidents must be reported to the Community Manager immediately.
7. No pets are permitted in the building at any time.
8. No smoking is permitted within the building at any time.
9. The use of the community center by guests or a group will at no time be allowed to exclude the use of the facilities by other residents.
10. Violations of these rules may result in (a) temporary revocation (up to 30 days) of community center privileges, (b) suspension of community center privileges, (c) fines and assessments, and/or (d) legal action against the violator.

Bulletin Board, News Policies
Approved by Directors

Formal policies governing items placed on bulletin boards in the clubhouse and outlining material that can be put into the Bellasera newsletter were approved by the Board of Directors at its April meeting.

Bulletin Board Policy

The bulletin board policy, moreover, allows for satellite bulletin boards to be located at each of the community's mailbox stations - a Communications committee project in the planning stages.

The directors approved two types of bulletin boards:

An official Bellasera Community Association bulletin board, at the front door of the clubhouse, will contain information concerning Bellasera board and committee meetings, a monthly calendar of events, and Board-approved social activities that are of interest to all residents. No commercial advertisements will be permitted on any of the official Community bulletin boards.

The future satellite boards will contain a subset of the official Community bulletin board.

The second type of board will be a "Residents' Information" board, located at the clubhouse. This will contain information that is considered useful to a majority of our residents. Postings on this board must relate to an appropriate resident activity or commercial venture, with strict maintenance rules.

Each posting on the Residents' Information board must be submitted to, approved and posted by the Bellasera Community Manager. Following approval, these postings will be marked with a date that is 60 days in the future. On that date, the positing will be removed. A renewal, for an additional 60 days, may be permitted only with the approval of the Community Manager.

Items posted without a stamped "pull date" will be removed.

All postings and removals will be made by the Community Manager.

Newsletter Policy

The newsletter policy sets forth subjects that may be included in the publication. Among these are articles on events or programs arranged exclusively for residents or homeowners, such as classes, with or without fees, where commercial solicitation is not the primary focus; information on committee meetings, rules and regulations, community events; and notices of meeting, events and activities extending beyond the Bellasera community that may be of interest to residents, based on the experience and judgment of the editorial staff.

The publication doesn't solicit or accept advertising; it isn't intended to publicize corporate entities, commercial organizations, businesses or licensed salespeople. Announcements regarding Bellasera resident business ventures may be included in the newsletter once only, if newsworthy, and if they are not intended to advertise.

Newsletter content will be determined using journalistic guidelines generally considered appropriate for a balanced presentation of news and information. The editorial staff will use its best judgment, consistent with the policy statement, to make decisions regarding content, and is under no obligation to use all material submitted.

Community Center Swimming Pool
Rules and Regulations

The Bellasera pool is for your use and enjoyment. We need the cooperation of all residents to make the pool a fun, safe and sanitary facility for everyone. Owners must advise all residents and their guests of the rules and safety precautions. The following rules must be observed at all times.

1. The common area owned by the Bellasera Community Association is available to Residents and their guests subject to all of the restrictions in the Bellasera governing documents as well as these and other Rules and Regulations adopted by the Association.
2. The swimming pool and spa are open daily from 5:00 am until midnight. Pool hours will be strictly enforced

4. At the discretion of the Community Manager, certain periods of the normal open swim hours may be set aside for specialized activities. These activities will be open to all interested Residents.
5. The use of association facilities by guests or a group will at no time be allowed to exclude the use of the facilities by other Residents.
6. There will not be a lifeguard on duty at the Bellasera Community Center pool. The use of the pool facilities is at the Resident or guest's own risk and by use of the facility the user agrees to hold the Bellasera Community Association harmless in regard to liabilities of any kind related to the use of the facility.
7. The pool is for the exclusive use of Residents and their invited guests.
8. Each household is entitled to host a reasonable number of pool guests at any time the Bellasera Community Pool is available. The Community Manager can revoke this privilege when the number of guests is unreasonable or the behavior of the guests is inappropriate.
9. A Resident who is eighteen (18) years of age or older must closely supervise children under the age of ten (10) while using the spa.
10. Parents are responsible for their children at all times. A Resident who is eighteen (18) years of age or older must accompany all children under the age of fourteen (14) at all times.
11. Owners are responsible for any damage they, their residents, or their tenants cause while using the facilities.
